These Terms of Service ("Terms") govern your use of the Galerie Slansky website (the "Site") and the purchase of artworks or services from Markus Slansky ("Artist"). By accessing the Site or making a purchase, you agree to be bound by these Terms completely and unconditionally.

We reserve the right to update or modify these Terms at any time without prior specific notice. The version of the Terms in effect at the time of your order will govern your purchase.

2. Artworks and Product Descriptions

We strive to accurately display the colors, textures, and details of original paintings and digital artworks. However, because every electronic display renders color differently, and because physical artwork textures are unique, we cannot guarantee that the physical item will precisely match your monitor's display. We are not liable for slight deviations in appearance.

4. Shipping, Delivery, and Transfer of Risk

Delivery times and shipping costs calculated at checkout are estimates. Once your package is handed over to the logistics provider (e.g., DHL, FedEx), we enter into the shipping execution phase.

5. Statutory Right of Withdrawal (EU Customers)

Under the EU Consumer Rights Directive, consumers residing within the European Union possess a statutory 14-day right of withdrawal from distance selling contracts.

6. Intellectual Property and Copyright

All copyright and intellectual property rights—including the rights of reproduction, distribution, and exhibition—remain permanently and solely with the artist, Markus Slansky.

Purchasing an original painting or print grants you ownership of the physical object only. You emphatically do NOT acquire the right to reproduce the image, use it for commercial branding, create derivative works, or mint Non-Fungible Tokens (NFTs) based on the image. Any such usage requires a separately negotiated, written licensing agreement directly from the artist.

7. Custom Commissions

Requests for commissioned paintings are subject to the artist's availability and approval. A non-refundable upfront deposit (typically 50% of the total price) is required before work commences. Because commissions are bespoke, they are considered final sales and are strictly ineligible for refunds or returns under standard consumer law.

8. Limitation of Liability

Galerie Slansky's total liability to you in connection with any purchase shall under no circumstances exceed the total purchase price paid for the artwork in question. To the fullest extent permissible by Austrian law, we preclude all liability for any indirect, special, incidental, or consequential damages (including loss of profit or emotional distress) arising from your use of the Site or the purchase of our products.

9. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

10. Governing Law and Dispute Resolution

These Terms, and any dispute arising out of or in connection with them or your purchase, shall be governed entirely by and construed in accordance with the laws of the Republic of Austria, expressly excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes shall be the competent courts in Austria, except where mandatory consumer protection laws dictate otherwise.
